Terms and Conditions – Parfender

1. Introduction
This page informs you about the terms and conditions under which we enter into agreements with you and deliver the products you order.
Where these terms refer to “we/us/our”, this means Parfender.
Please read these Terms and Conditions carefully before purchasing a product via our website or through a Parfender vending machine. These terms apply to all agreements, deliveries, orders, promotions, and sampling campaigns carried out by or on behalf of us.

2. Definitions
Parfender: the trade name of our company, registered in the Netherlands.
Products: all items we sell through our website or vending machines, including decanted authentic perfumes in our custom-developed travel-size bottles and holders, full-size perfume bottles, and related products and accessories.
Customer: any natural or legal person who enters into an agreement with us.
Service Areas: the Netherlands, Belgium, and other countries where we offer delivery or vending machine placement.
Order: any purchase of one or more products via our webshop or vending machine.
Agreement: the sales contract between Parfender and the customer.
3. About us
We sell on our websites and through vending machines decanted authentic perfumes in our custom-developed travel bottles and holders, full-size perfume bottles, and related products and accessories.
The perfumes in our travel bottles are decanted by us. We are not in any way affiliated with, endorsed by, or associated with the designer or manufacturer of the perfumes.
4. Applicability
4.1 These terms apply to all offers, orders, agreements, and deliveries.
4.2 Deviations are only valid if agreed upon in writing.
4.3 Any general or purchasing terms of the customer are expressly rejected.
5. Use of vending machines
5.1 The use of Parfender vending machines is entirely at the customer’s own risk. Customers are responsible for the correct and careful use of the machine and the products dispensed from it, and for following all instructions displayed on or near the machine.
5.2 Parfender cannot be held liable for any damage, injury, or inconvenience resulting from misuse of the machine or from not following the instructions displayed on or near the machine.
5.3 Customers must not insert their hands or any other body parts into the machine, attempt to open, tamper with, or otherwise interfere with the machine. Any attempt to obtain products in an unauthorized manner shall be considered theft and may lead to legal action, including claims for damages caused to the machine.
5.4 In the event of a technical malfunction or failed transaction, the purchase amount will be automatically or, upon request, refunded. Parfender shall not be liable for any consequential or indirect damages related to the use of the machine.
6. Prices
6.1 All prices include VAT and any other applicable taxes, unless stated otherwise.
6.2 Prices shown in vending machines and on the website are current, but we reserve the right to change them at any time.
6.3 If a price error is obvious and unmistakable, we are not obliged to supply the product at the incorrect price.
7. Orders and formation of the agreement
7.1 An agreement is concluded when the customer places an order via the website and receives a confirmation, or upon purchase through a vending machine.
7.2 Parfender reserves the right to refuse orders or to impose additional conditions.
8. Delivery
8.1 Products are delivered to the address provided by the customer or dispensed directly via the vending machine.
8.2 Delivery times are indicative and do not entitle the customer to compensation if exceeded.
8.3 Delivery times may be longer around public holidays or in special circumstances.
8.4 All products are delivered in their current condition. We do not guarantee specific results or effects.
9. Returns and right of withdrawal (webshop orders only)
9.1 For purchases via our website, the statutory right of withdrawal of 14 days applies, starting from the day the order is received.
9.2 For hygiene reasons, perfumes whose seal has been broken cannot be returned.
9.3 Purchases made via vending machines are not covered by the right of withdrawal, unless the product is defective or does not conform to the agreement.
9.4 Return shipping costs are at the customer’s expense, unless the product is incorrect or defective.
10. Payment
10.1 Payment can only be made using the payment methods offered on our website or via the vending machine payment system.
10.2 All payments must be made in full before delivery takes place.
11. Promotions and discounts
11.1 Promotions and offers are valid while stocks last.
11.2 Discount codes are only valid under the specific conditions set by Parfender.
12. Use and liability
12.1 Products must only be used as intended and in accordance with the instructions provided.
12.2 It is the customer’s responsibility to check the list of ingredients and assess whether the product is suitable for personal use. Parfender cannot be held liable for allergic reactions or skin irritations. In case of doubt about (possible) allergies or skin sensitivities, we strongly advise the customer to consult a medical specialist or doctor in advance.
12.3 Parfender is not liable for damage caused by misuse of the product.
12.4 Our liability is limited to the purchase price of the product.
12.5 The products are intended for personal use only. Resale or commercial use of our products is not permitted without our prior written consent.
13. Intellectual property rights
13.1 All texts, photos, designs, and packaging are protected by intellectual property rights and may not be used without prior permission.
13.2 All brand names, logos and trademarks mentioned are the property of their respective owners. These are used solely to identify the fragrances. Parfender is completely independent of the brands and manufacturers in question.
13.3 It is prohibited to reproduce or imitate our products or packaging.
14. Complaints procedure
14.1 Please check the product immediately upon receipt or purchase.
14.2 Any complaints must be reported within 14 days of purchase to info@parfender.com.
14.3 Parfender will handle complaints as quickly as possible and within a maximum of 14 days.
15. Force majeure
15.1 We are not liable for delays or shortcomings caused by circumstances beyond our control, such as strikes, extreme weather conditions, market shortages or transportation disruptions.
16. Governing law and disputes
16.1 All agreements are governed exclusively by Dutch law.
16.2 Any disputes will be submitted to the competent court in Amsterdam, the Netherlands.
16.3 Any mandatory consumer rights applicable in the customer's country remain unaffected.
